Applies to bookings made through indigenoustourism.com.au, operated by Songlines Digital ("we", "us", the "Platform"). Each Operator's own cancellation policy is shown to you before you pay and sits alongside these terms.
1. Who you are contracting with
1.1 When you book an experience through this site, your contract for the experience itself is with the Operator who supplies it: the tour, activity or event business named on the listing. It is not with us.
1.2 We operate the booking platform that lets you find, pay for and receive tickets for the Operator's experience. We are a facilitator, not the supplier. Operators are independent, verified Indigenous owned businesses. We are not their employer, agent or principal.
1.3 Our role as facilitator does not reduce any right you have against us under law that cannot be excluded, including under the Australian Consumer Law (clause 6).
2. Bookings, prices and GST
2.1 Prices shown at checkout are the total price payable in Australian dollars, inclusive of GST where GST applies. No booking fee is added to the price you see.
2.2 When you start checkout, the places you have chosen are held for a short time while you pay. If payment is not completed in that time the hold lapses and the places are released.
2.3 A booking is confirmed when your payment succeeds and we email you a confirmation with your ticket. Until then availability is not guaranteed.
2.4 You do not need an account to book. We collect your name, email address, phone number and booking details to process the booking and issue your ticket. See the Privacy Policy.
3. Payment
3.1 Payment is processed by Stripe. Your payment settles to the Operator's own Stripe account, and the Platform receives a fee from the Operator's side of the transaction. You are not charged that fee separately.
3.2 We never see or store your card number. Card details are entered into Stripe's secure payment form and handled under Stripe's own terms and security standards.
3.3 The Platform does not hold your booking money in its own account at any point.
4. Tickets and entry
4.1 Your emailed ticket, including its QR code, is your proof of booking. A screenshot, or the Apple Wallet or Google Wallet pass you can add from the confirmation email, is accepted unless the listing says otherwise.
4.2 Entry conditions such as age limits, fitness requirements, what to wear and what to bring are set by the Operator and shown on the listing. Read them before you book.
4.3 Some experiences require you to sign a separate waiver or acknowledge safety requirements directly with the Operator. Where that applies the listing says so. A waiver cannot exclude liability for death or personal injury caused by negligence, or your consumer guarantee rights, to the extent the law prohibits it.
5. Cancellations, changes and refunds
5.1 Each Operator sets the cancellation policy for each experience. It is shown on the listing and at checkout before you pay. A policy states how many hours before the start time you can cancel for a full refund, and may state a later window in which a partial refund applies. Inside the final window no refund may be payable for a change of mind.
5.2 The Operator's policy sits on top of your rights under the Australian Consumer Law and cannot reduce them. In particular:
- If the Operator cancels the experience, substantially changes it, or fails to deliver it as described, that is a major failure and you are entitled to a refund or compensation for the drop in value, whatever the stated policy says.
- If something goes wrong that does not undermine the essential nature of the experience, that is a minor failure and the Operator may offer to fix it, for example by rescheduling, rather than refund.
- A change of mind on your part is governed by the Operator's stated policy. The law does not require a refund for a change of mind.
5.3 Where an Operator cancels for weather, safety or conditions outside anyone's control, the Operator's stated policy on rebooking and refunds applies, always subject to clause 5.2.
5.4 To cancel or ask for a refund, contact the Operator using the details on your confirmation, or contact us (clause 11) and we will arrange it with the Operator. Refunds are issued through the Platform to the card you paid with. The Platform's fee is returned to the Operator in the same proportion, so it never reduces what you get back.
5.5 A refund may be issued as store credit only if you agree to that instead of money back.
6. Your rights under the Australian Consumer Law
6.1 Services supplied to you by the Operator, and the booking service we supply, come with consumer guarantees under the Australian Consumer Law that cannot be excluded, restricted or modified.
6.2 Nothing in these terms or in any Operator policy is intended to exclude, restrict or modify those guarantees. Any clause that would have that effect is read down to the extent needed to comply with the law.
6.3 If you believe an Operator's policy conflicts with your consumer rights, contact us. We will help resolve it with the Operator, who remains primarily responsible for the experience supplied.
7. Reviews
7.1 After your experience we may invite you by email to leave a review. Reviews are checked before publication and we may decline to publish a review that is unlawful, defamatory or that we reasonably believe is not genuine.
7.2 A review is the reviewer's own opinion, not our endorsement.
8. Gift vouchers and store credit
8.1 Store credit issued through the Platform, for example in place of a refund where you have agreed to that, does not expire earlier than three years from the date of issue, as the Australian Consumer Law requires.
8.2 Store credit is a liability of the Operator who issued it and can be used only with that Operator. The expiry date and conditions are shown when the credit is issued and on the credit record.
8.3 Store credit is not redeemable for cash except where the law requires it.
9. Waitlists and reminders
9.1 If an experience is full you may join a waitlist. We email you if a place becomes available. Joining a waitlist does not create a booking.
9.2 If you start a booking but do not finish paying, and you have ticked the marketing box at checkout, we may send you a single reminder email. We do not send that email without your consent.
10. Liability
10.1 To the extent the law permits, and subject always to clause 6, our liability to you in connection with the booking service, as distinct from the experience itself, is limited to the fee we received for your booking.
10.2 We are not liable for the acts, omissions, safety practices or service quality of Operators, who are independent businesses. This does not affect your rights under the Australian Consumer Law, including any that apply against us as supplier of the booking service.
10.3 Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.
11. Complaints and contact
11.1 For a problem with the experience itself, contact the Operator using the details on your confirmation, or contact us and we will help.
11.2 For a problem with the booking site, a payment, a ticket or a store credit balance, email [email protected].
11.3 You may also contact the Queensland Office of Fair Trading, the consumer protection body in your own state or territory, or the Australian Competition and Consumer Commission about consumer law matters.
12. Governing law
12.1 These terms are governed by the law of Queensland, Australia. You and we submit to the non exclusive jurisdiction of its courts.
